§ 1 General provisions and definitions
1. The website www.against-gravity.com operating at www.against-gravity.com (hereinafter: the Website) is operated by: Against Gravity Group Sp. z o. o., based in Słupsk, ul. Wojska Polskiego 25/2, 76-200 Słupsk, registered in the register of entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 8th Commercial Division of the National Court Register under KRS number 0000466621, NIP 7412126033, REGON 281507474, (hereinafter: AGG)
2. AGG sells and provides Digital Services via the Website, using means of distance communication. Agreements concluded by the Customer with AGG via the Website are distance contracts within the meaning of the Act of May 30, 2014 on consumer rights.
3. The Customer is entitled and obliged to use the Website in accordance with its intended purpose and the principles of social coexistence and good manners.
Browsing the Website does not require registration, but placing orders for Products by the Customer requires registering an account.
4. The Regulations are available free of charge on the Website, in a form enabling their acquisition, reproduction and recording.
5. The Customer is obliged to read the Regulations. Using the Website is possible only after reading and accepting the Regulations. The client may be a person with full legal capacity.
6. The definitions used in the Regulations mean:

Customer – a person using the Website, purchasing Digital Services provided by AGG as part of the Website;

Digital service – digital service within the meaning of Art. 2 point 5a of the Act of May 30, 2014 on consumer rights, provided by AGG, offered to Customers via the Website;

Website – website at www.against-gravity.com through which AGG provides Digital Services electronically to the Customer;

Agreement – an agreement concluded between AGG and the Customer via the Website;

Account – an individual account of the Customer on the Website, enabling him to use the Digital Services after logging in;

Working days - all days from 9:00 a.m. to 5:00 p.m. GMT+1, excluding Saturdays, Sundays and public holidays;

Regulations – these regulations.
7. In the event of a justified suspicion that the Customer has provided false data, AGG has the right to withdraw from the Agreement and notify the Customer thereof.
8. If the Customer provides incorrect or inaccurate data, in particular an incorrect or inaccurate e-mail address, AGG shall not be liable for failure to provide the Digital Service to the fullest extent permitted by law.
9. The information contained on the Website, including in particular announcements, advertisements and price lists, does not constitute an offer within the meaning of Art. 66 of the Act of 23 April 1964, Civil Code. The information contained on the Website constitutes an invitation to conclude the Agreement, described in Art. 71 of the Civil Code.
10. Services can be ordered 24 hours a day, 7 days a week.
§2 Technical requirements necessary to use the Website
1. To browse the Website, it is necessary: end device with access to the Internet,
web browser enabling the acceptance of cookies; for example, Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari in their current version; acceptance of necessary cookies.
2. To use the functionalities of the Website, in particular, to register on the Website or place orders for Digital Services, an active e-mail account is required.
3. The website uses cookies to properly provide the Services and to ensure security. Blocking cookies, as well as using external applications to block them, may result in incorrect operation of the Website and may prevent the proper implementation of the Services, for which AGG is not responsible.
4. Registration on the Website and subsequent login is possible by providing your e-mail address (Login) and Password or by integration with your Facebook or Google+ account.
§3 Shopping on the Website and order fulfillment
1. The prices of goods visible on the Website are total gross prices for Digital Services, include value added tax (VAT) and are expressed in PLN and EUR.
2. The Digital Service selected for purchase should be added to the cart on the Website.
3. Then the Customer selects the Digital Services on the Website, as well as the deadline for the implementation of the Digital Service and the method of payment for the order, and provides the data necessary to complete the order.
4. The order is placed when its content is confirmed and the Customer accepts the Regulations.
5. Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
6. The Seller confirms the conclusion of the contract by sending electronically a notification of acceptance of the order for execution.
7. AGG will start implementing the Digital Service after the payment is credited to the Seller's account.
8. Taking into account the provisions of the previous paragraph, AGG provides the Customer with a Digital Service after concluding the Agreement, on the date selected by the Customer on the Website and on the terms described in the selected Digital Services, unless the parties have agreed otherwise.
9. The Customer may change the order completion date, no later than 4 hours before the planned implementation date of the Digital Service, by e-mail to the following e-mail address: magdalena@against-gravity.com. AGG will return within 3 business days with a proposal for a different date for the implementation of the Digital Service.
10. AGG also reserves the right to change the order completion date no later than 4 hours before the proposed date of the Digital Service, by contacting the Customer electronically to the e-mail address and indicating other available dates for the implementation of the Digital Service.
11. If AGG does not confirm acceptance of the order electronically, for reasons beyond AGG's control, AGG reserves the right to refuse to process the order.
12. AGG also reserves the right to refuse to process unpaid orders, placed incorrectly, or contain information that cannot be confirmed by e-mail, as well as orders placed by Customers who do not comply with the rules described in these Regulations and included in the specifications of the Digital Services. in the service.
13. The "CV & Portfolio Review" digital service is considered completed when the service client takes part in a personalized CV consultation meeting and receives tips and recommendations regarding changes and improvements to the content of the CV, portfolio and/or profile on the Linkedin platform or other platforms. platforms related to the presentation of a professional profile.
14. The digital service "Mockup Interview for Gamedev Specialists" is considered completed when the Client takes part in a personalized meeting consisting of a trial recruitment interview and receives tips and recommendations regarding further preparation for the actual recruitment interview.
§4 Payments
1. Payments can be made via the Stripe payment service, with credit and debit cards:

2. The payment terms are specified in the regulations for providing services by Stripe.
3. By making purchases on the Website, the Customer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance.
§5 Right to withdraw from the contract
1. The Customer has the right to withdraw from the contract concluded with the Seller via the Website, subject to § 6 of the Regulations, within 14 days without giving any reason. The contract from which the Customer has withdrawn is considered null and void.
2. To withdraw from the contract, it is sufficient to send AGG an e-mail entitled "Withdrawal from the contract" to the following address: magdalena@against-gravity.com, within 14 (in words: fourteen) days from the conclusion of the contract.
3. In the event of withdrawal from the contract, the refund is made in the same way in which the payment was made by the Customer. AGG will refund the funds within 14 (fourteen) calendar days.
4. If the Customer withdraws from the contract, the fee charged for the order will be returned to the Customer's account reduced by 3% of its value.
5. AGG will also correct the proof of purchase previously provided to the Customer (VAT correction invoice or correction specification).
§6 Exceptions to the right to withdraw from the contract
1. The Customer is not entitled to withdraw from the contract in the cases specified in the Act of May 30, 2014, on consumer rights, in particular in relation to contracts:

for the provision of services for which the consumer is obliged to pay the price, if the seller has fully performed the service with the express and prior consent of the consumer, who was informed before the commencement of the provision that after the entrepreneur has completed the service, he will lose the right to withdraw from the contract and has acknowledged this ;

in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the contract;

for the supply of digital content not delivered on a tangible medium for which the consumer is obliged to pay the price, if the entrepreneur commenced the provision with the express and prior consent of the consumer, who was informed before the commencement of the provision that after the entrepreneur has completed the provision, he will lose the right to withdraw from the contract, and has accepted this is known, and the entrepreneur has provided the consumer with the confirmation referred to in Art. 15 section 1 and 2 or art. 21 section 1 of the Consumer Rights Act.

§8 Complaints
1. The complaint must be submitted to the Seller electronically, within 14 (say: fourteen) days from the completion of the Digital Service order.
2. The Seller will consider the complaint within 14 (fourteen) days.
3. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others: With:

assistance of the locally competent permanent consumer arbitration court operating at the Provincial Inspectorate of the Trade Inspection, to which an application to consider the case before the arbitration court should be submitted. §9 Personal data
1. The administrator of Customers' personal data collected via the Website is the Seller.
2. Personal data of Customers concluding contracts for the implementation of Digital Services via the Website are collected by the Administrator to implement the Agreement, and if the Customer consents - also for marketing purposes.
3. The recipients of personal data of Website Customers may be:
in the case of a Customer who uses electronic or payment card payment on the Website, the Administrator provides the collected personal data of the Customer to the selected entity handling the above payments on the Website.
4. The customer has the right to access and correct his data. To exercise his rights, the Customer should contact the Seller using the data from § 7 of the Regulations.
5. Providing personal data is voluntary, although failure to provide the personal data indicated in the Regulations necessary to conclude the Sales Agreement results in the inability to conclude this agreement.

§10 Final provisions
1. Each order placed on the Website constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded on time and to complete the order.
2. The Seller reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal provisions, changes in payment methods and others - to the extent that these changes affect the implementation of the provisions of these Regulations. Changes to the Regulations will be announced on the Website: www.against-gravity.com
3. In matters not regulated by these Regulations, the provisions of the Act on the provision of electronic services, the Civil Code, the Personal Data Protection Act and other applicable legal provisions shall apply.
4. In the event of any dispute with the Customer, the competent court will be the court appropriate for the Seller's registered office.
